JOB SAFETY EMPLOYEE LAWYER
Many wrongful termination cases involve complaints of workplace safety, and then a job termination. Sometimes employee quit due to safety issues at work. Job safety also can lead to a workplace injury. Finally, under certain circumstances it is worth filing PAGA charges due to an unsafe workplace. The Employment Lawyers Group handles all of these different workplace safety issues when the employee is ready to move forward with actual legal action. Their firm founder, Karl Gerber, understands workplace safety issues because he works with labor all the time in order to do ground-up construction.
Stump grinders, especially ones this large, are dangerous pieces of machinery. They should only be operated while wearing safety glasses, gloves, ear protection, and steel tip shoes. It is also important that they not be operated on non-level ground. The purpose of this picture is to show you how not to operate a stump grinder.
If your employer demands that you work without adequate safety equipment you may well have cause for quitting and suing if the employer is given an opportunity to correct the situation but refuses. Job terminations due to complaints about employee safety are wrongful termination in California.
Take your job seriously, act like a professional; use safety equipment and operate machinery in the manner it is made to be operated in opposed to what is quickest and most convenient.

Jobsite safety is very important. For instance if you are going to ride your bicycle through a construction site it is important to wear a helmet.

FIRED FOR COMPLAINING ABOUT NOT RECEIVING THE PROPER PERSONAL PROTECTIVE EQUIPMENT PPE?
Some employment lawsuits revolve around complaints the plaintiff makes that the employer did not provide proper safety equipment (PPE).
These temporary agency employees were equipped with proper safety equipment including gloves and steal tipped shoes. They were also supplied the statutorily required water by the Employment Lawyers Group. Construction work is hard work and presents grave physical demands. It is important safety be exercised on all jobsites. California law requires shade, water, and adequate adherence to employee health and safety. When these items are not supplied it is a Labor Code violation. If employees complain of the need of these things and are fired they are whistleblowers who can make wrongful termination cases. We recently had one that resulted in a $625,000 settlement.

Personally, we think there is just too much going on at this job site. Half formed temporary rebar, a ladder in the middle of the formation, wood on top of rebar, boundary and level marking forms, piles of dirt, and the list goes on. Luckily this little movie prop during the building of our new Oxnard office underwent changes the next day. Everybody was also wearng steel toe boots.

At one point, the construction of the Oxnard Office became so desperate we resorted to child labor without normal safety equipment such as gloves or a hard hat. But then again if your kid picks up a hammer and crow bar and wants to smash a useless piece of non-structural framing do you really have to pay him? On a serious note, we do not condone child labor. In fact, minors are not allowed to work on construction sites at all. this picture was taken some years ago. Apparently these type of construction experiences motivated this particular boy to want to be an engineer.

#Unsafe Labor
Workplace safety is very important. When we were working Oxnard office remodeling crew, we reminded them of the need for safety equipment. We had hard hats, gloves, masks, and tried to clean up dangers immediately. With that said, Gerber moved 11,000 pounds of rock one day only to realize there was a growing pile of roofing tile to dispose of.

Asbestos remediators like to use plastic and seal everything; even if it isn't an asbestos containing item. Well, was the existing porch of the Oxnard office which was demolished soon after the asbestos remediators removed all of the drywall from the Oxnard office.

Since the above picture was taken, the Employment Lawyers Group has continued to represent workers who complain about improper asbestos and mold remediation. Those facts often create good wrongful termination cases.
